Confirm with the Ministry of Health, Labor and Welfare in advance that cannabis does not fall under the Cannabis Control Act

Once you have found a potential supplier and received a positive response regarding export, this is the next step.

Even if you find the CBD ingredients or product you want, if it is illegal under Japanese law, you cannot import it.

Specifically, you will need to obtain the following documents from the manufacturer and submit them to the Ministry of Health, Labour and Welfare, which is the ministry responsible for regulating cannabis.

Once the documents have been checked by the Ministry of Health, Labor and Welfare's Kanto-Shinetsu Regional Narcotics Control Division and it has been confirmed that the cannabis is not subject to regulation under the Cannabis Control Act, you can move on to the next step.

Confirm in advance with the prefectural pharmaceutical affairs department that the product is not a pharmaceutical product under the Pharmaceuticals and Medical Devices Act

This is the step where we check whether the raw materials and products contain any pharmaceutical ingredients based on the ingredient list obtained from the overseas manufacturer.

The responsible ministry is the pharmaceutical affairs department of the prefecture in which the office is located.

Naturally, if it contains pharmaceutical ingredients, it cannot be imported.

Please note that this confirmation may also be requested by the food quarantine station when the imported goods actually arrive.

Confirm food safety in advance with the food quarantine station

This is also a step in which we check whether food safety is guaranteed based on the CBD raw materials procured from overseas manufacturers and the product's ingredient list and manufacturing process chart.

The responsible ministry is the quarantine station at the importation point.

If there is any doubt about its safety, it cannot be imported.

Contract and Order

Once it has been confirmed that the product complies with the relevant Japanese laws (Cannabis Control Act, Pharmaceuticals and Medical Devices Act, and Food Sanitation Act), we can begin specific import negotiations.

Once an agreement is reached with the overseas manufacturer on the terms (price, quantity, delivery date, trade terms) and contract contents, the contract and order can be made.

We will arrange transportation and customs brokerage if necessary.

Food import notification

This is a step that is unique to commercial imports and not included in personal imports.

Specifically, prior to declaring an import at customs, a food import notification form, ingredients list, manufacturing process chart, invoice, packing list, etc. must be submitted to the Food Quarantine Station of the Ministry of Health, Labour and Welfare, which is the ministry in charge of food regulations.

The judgment will vary depending on the product type, the exporting country, and the inspector in charge, but in order to determine whether the product complies with the regulations of the Food Sanitation Act, you will often be asked to submit additional documents that were not required during the preliminary inspection.

CBD ingredients and products that have no history of being imported into Japan will be subject to an inspection order and will not be able to be imported unless they pass this.

Once the final customs inspection is completed and customs duties are paid, an import permit notice is issued and the import is complete.
